Terms of Service

1. Eligibility

You must be at least 18 years of age to create an account or place orders on the Platform. By using the Platform, you represent and warrant that you meet this requirement. Certain products (including alcohol and nicotine products) require additional age verification and are available only to users who are 21 years of age or older, as required by Alabama law. Doorhaul reserves the right to refuse service to any person at any time for any lawful reason.

2. Account Registration

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized use of your account.

3. Platform Services

Doorhaul is a technology platform that connects customers with local restaurants, retailers, and independent delivery drivers ("Haulers") in Baldwin County and Mobile, Alabama. Doorhaul does not prepare food, operate restaurants, or employ Haulers as employees. All food preparation is the sole responsibility of the restaurant or store partner. All delivery services are performed by independent contractors.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

4. Orders and Payments

When you place an order through the Platform, you are making an offer to purchase the selected items from the applicable restaurant or store partner. Doorhaul facilitates the transaction on behalf of the partner. All prices displayed are in U.S. dollars and are subject to change without notice. Applicable sales tax, delivery fees, and service fees will be disclosed at checkout before you confirm your order.

Payment is processed securely through Stripe. By providing payment information, you authorize Doorhaul and its payment processors to charge the applicable amounts to your selected payment method. All sales are final unless otherwise stated in our Refund Policy below.

5. Refunds and Cancellations

You may cancel an order within two (2) minutes of placement for a full refund. After that window, cancellations are subject to the restaurant or store partner's cancellation policy. If your order is materially incorrect, missing items, or the food is unsafe to consume, you may request a refund or credit by contacting support within 24 hours of delivery. Doorhaul reserves the right to issue refunds in the form of platform credits at its sole discretion.

6. Haul Pass Subscription

Doorhaul offers a subscription service called "Haul Pass" that provides subscribers with reduced or waived delivery fees on eligible orders. Haul Pass is billed on a recurring monthly or annual basis. You may cancel your Haul Pass subscription at any time; cancellation takes effect at the end of the current billing period. Haul Pass fees are non-refundable except as required by applicable law. Doorhaul reserves the right to modify Haul Pass pricing or benefits with 30 days' notice.

7. Age-Restricted Products

The sale and delivery of alcohol and tobacco/nicotine products are subject to Alabama state law. By ordering such products, you represent that you are at least 21 years of age. Doorhaul and its Haulers reserve the right to require government-issued photo identification upon delivery and to refuse delivery if the recipient cannot verify their age or appears to be intoxicated. No refunds will be issued for refused deliveries due to failed age verification.

8. User Conduct

You agree not to use the Platform to: (a) violate any applicable law or regulation; (b) submit false, misleading, or fraudulent information; (c) harass, threaten, or harm any Hauler, restaurant partner, or other user; (d) interfere with or disrupt the Platform or its servers; (e) attempt to gain unauthorized access to any part of the Platform; or (f) use the Platform for any commercial purpose not expressly authorized by Doorhaul. Violation of these rules may result in immediate account termination.

9. Reviews and Content

By submitting reviews, photos, or other content to the Platform, you grant Doorhaul a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and distribute such content in connection with the Platform. You represent that you own or have the right to submit such content and that it does not violate any third-party rights. Doorhaul reserves the right to remove any content that violates these Terms or that we deem inappropriate.

10. Intellectual Property

The Platform and all content, features, and functionality (including but not limited to the Doorhaul name, logo, and design) are owned by Doorhaul LLC and are protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without our express written permission.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DOORHAUL DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOORHAUL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL DOORHAUL'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DOORHAUL IN THE 90 DAYS PRECEDING THE CLAIM OR (B) $100.

13. Indemnification

You agree to indemnify, defend, and hold harmless Doorhaul and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Platform shall be resolved by binding arbitration in Baldwin County, Alabama, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction. YOU WAIVE ANY RIGHT TO A JURY TRIAL OR CLASS ACTION.

15. Changes to These Terms

Doorhaul reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending an email notification. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
