Driver Independent Contractor Agreement
This Driver Independent Contractor Agreement ("Agreement") is entered into between Doorhaul LLC ("Doorhaul") and the individual ("Hauler") who applies to provide delivery services through the Doorhaul platform. By submitting a driver application or activating your Hauler account, you agree to be bound by this Agreement.
1. Independent Contractor Status
Hauler is an independent contractor and not an employee, agent, partner, or franchisee of Doorhaul. Doorhaul does not control the manner or means by which Hauler performs delivery services. Hauler retains the right to perform services for other platforms or businesses while not actively fulfilling a Doorhaul delivery. Nothing in this Agreement shall be construed to create an employment relationship, and Hauler is not entitled to employee benefits of any kind from Doorhaul, including but not limited to health insurance, workers' compensation, unemployment insurance, or paid leave.
2. Eligibility Requirements
To be eligible to provide services as a Hauler, you must:
- Be at least 18 years of age
- Possess a valid U.S. driver's license (for vehicle deliveries)
- Maintain valid auto insurance meeting Alabama minimum requirements (for vehicle deliveries)
- Have a smartphone capable of running the Doorhaul driver app
- Pass Doorhaul's background check screening
- Be legally authorized to work in the United States
3. Services
Hauler agrees to pick up orders from restaurant and store partners and deliver them to customers within the designated delivery zone. Hauler is responsible for ensuring orders are delivered accurately, promptly, and in good condition. Hauler must treat all customers, restaurant partners, and Doorhaul staff with professionalism and courtesy.
For deliveries involving age-restricted products (alcohol, tobacco/nicotine), Hauler must verify the recipient's government-issued photo ID and confirm the recipient is at least 21 years of age. Hauler must refuse delivery if the recipient cannot verify their age or appears to be intoxicated. Hauler will not be penalized for compliant refusals.
4. Compensation
Doorhaul will pay Hauler a per-delivery fee based on the applicable rate schedule, which may vary by delivery zone, distance, order size, and time of day. Surge bonuses may be available during high-demand periods. Hauler is solely responsible for all federal, state, and local taxes on earnings, including self-employment taxes. Doorhaul will issue a Form 1099-NEC to Haulers who earn $600 or more in a calendar year.
Earnings are paid via direct deposit on a weekly basis. Hauler is responsible for maintaining current and accurate payout account information.
5. Vehicle and Equipment
Hauler is responsible for providing and maintaining their own vehicle, bicycle, or other delivery equipment in safe and operable condition. Doorhaul does not provide vehicles, fuel, or equipment. All costs associated with vehicle operation, maintenance, fuel, and insurance are the sole responsibility of the Hauler. Hauler's vehicle must comply with all applicable Alabama vehicle registration and inspection requirements.
6. Insurance
Hauler is responsible for maintaining adequate insurance coverage for their vehicle and delivery activities. Doorhaul does not provide auto insurance, liability insurance, or workers' compensation coverage for Haulers. Hauler acknowledges that their personal auto insurance policy may not cover commercial delivery activities and agrees to obtain appropriate coverage. Doorhaul strongly recommends Haulers obtain a commercial auto or rideshare endorsement.
7. Conduct and Standards
Hauler agrees to:
- Comply with all applicable traffic laws and regulations
- Not operate a vehicle while impaired by alcohol, drugs, or any substance
- Not harass, threaten, or engage in discriminatory conduct toward any customer, partner, or Doorhaul employee
- Maintain a customer rating above the minimum threshold set by Doorhaul (currently 4.0 out of 5.0)
- Not tamper with, consume, or misrepresent any order
- Report any accidents, incidents, or safety concerns to Doorhaul promptly
8. Background Check and Ongoing Screening
Hauler consents to a background check as a condition of activation and to periodic re-screening as required by Doorhaul. Doorhaul reserves the right to deactivate any Hauler whose background check reveals disqualifying information, including but not limited to felony convictions, DUI/DWI convictions within the past seven years, or sex offender registration.
9. Deactivation
Doorhaul may deactivate a Hauler's account at any time for cause, including but not limited to: violation of this Agreement, failure to maintain eligibility requirements, sustained low customer ratings, fraudulent activity, or conduct harmful to customers, partners, or the Doorhaul brand. Hauler may also deactivate their account at any time by contacting support. Any outstanding earnings will be paid within 14 business days of deactivation.
10. Indemnification
Hauler agrees to indemnify, defend, and hold harmless Doorhaul and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Hauler's performance of delivery services; (b) Hauler's breach of this Agreement; (c) Hauler's negligence, recklessness, or willful misconduct; (d) any vehicle accident or property damage caused by Hauler; or (e) Hauler's violation of any applicable law.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOORHAUL SHALL NOT BE LIABLE TO HAULER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT OR HAULER'S USE OF THE PLATFORM. DOORHAUL'S TOTAL LIABILITY TO HAULER SHALL NOT EXCEED THE TOTAL EARNINGS PAID TO HAULER IN THE 30 DAYS PRECEDING THE CLAIM.
12. Governing Law and Dispute Resolution
This Agreement shall be governed by the laws of the State of Alabama. Any disputes shall be resolved by binding arbitration in Baldwin County, Alabama, under the rules of the American Arbitration Association. HAULER WAIVES ANY RIGHT TO A JURY TRIAL OR CLASS ACTION.
